Terms and conditions
We ask you to observe our general terms and conditions which regulate the contractual relationship between you as the client/guest and us.
1. Validity of the contract
1.1 The contract is valid as soon as a course-health treatment of Ayurveda Mallorca® is booked and confirmed or if it is bindingly reserved in case a written confirmation is no longer possible due to scheduling reasons.
1.2 If the client/ applicant is acting as a full merchant he shall be liable for all contractual obligations together with those of his guests and/or other participants.
1.3 If the content of our confirmation should be different from the content of the guests’ application, the different contents will be binding if the guest has not contradicted to them within 10 days of receiving the confirmation.
2. Arrival and departure
2.1 Arrival and departure: Unless otherwise agreed in writing, the guest cannot move into the room before 3pm on the day of arrival. On departure, the room is reserved until 11am that day. The guest is asked to inform the Administration no later than 6pm the day before departure, if he wants to make a change to these standard times.
2.2 Moving into reserved rooms must be effective no later than 6pm on the day of arrival. If the guest does not arrive until this designated time without any prior notice, the Ayurveda center can rent the room to other guests.
3. Services, Prices
3.1 The contracted services arise from the advertised offers in our brochure or internet site and from the information provided in the reservation confirmation. Unless otherwise stated, the prices include the respective length of stay with the applications contractually agreed. For extension of the stay as well as any additional services, treatments and applications, separate billing will be set up.
3.2 If the guest who booked Ayurvedic all-inclusive package, receives a lunch on the first day upon arrival then the food service ends with a breakfast on the last day of the stay; if it starts with a dinner, it ends with a lunch.
3.3 A refund for paid but unused services or treatments is not possible.
3.4 In case a guest cannot start its pre-booked stay due to illness or due to urgent family matters (death of close relative, etc.) and can prove this by submitting a medical certificates or equivalent, the payment obligation will be cancelled, unless otherwise stipulated in Paragraph 5. A payment already made can be accredited to a new reservation by the guest or by any other related person within one year from date of payment. Payments are non-refundable. We can offer partner agencies for travel cancellation insurance during the time of booking.
3.5 The prices shown are fully inclusive prices and include the complete scope of services announced.
3.6 If the period of time between signing of the contract and start of the booked service is more than 6 months, we reserve the right to make price or service adaptions/changes without prior notice.
3.7 All prices are valid in Euros. If a foreign currency is specified, then this is meant only for the mandatory orientation depending on the exchange rate to Euro at time of publication.
4. Terms of payment
4.1 After the receipt of the reservation confirmation a payment of 50% of the total invoice amount is due within 1 week; the payment of the balance is due no later than four weeks before arrival. For last minute bookings full payment is required on the day of arrival.
4.2 Deviating from this, full payment needs to be made for special offers, such as early booking discounts, regular customer bonuses, or last minute offers. Usually the entire price payment is required for reservation of such offers.
5. Cancellation by the guest
5.1 All cancellation must be submitted in writing.
5.2 The costs of cancellation or termination will depend on the booked service and the invoice amount of the booking confirmation and are calculated as follows:
5.2.1 In case of withdrawal or cancellation of bookings up to 4 weeks prior to arrival, a handling fee of 5% of the booking value will be charged.
5.2.2 In case of withdrawal or cancellation between 4 and 2 weeks before the day of arrival, 50% of the agreed price will be charged.
5.2.3 In case of withdrawal or cancellation of less than 2 weeks before the day of arrival, 80% of the agreed price will be charged.
5.2.4 In case of non-use of contractual performance or services, 80% of the agreed price will be charged.
For such cases, we suggest to enter into a travel insurance contract.
6.1 The Ayurveda Centre shall not be liable for disruptions of external services which are merely negotiated and expressly identified in the prospectus/order.
6.2 Ayurveda Mallorca® is not liable for the services rendered by third parties, which are only marketed by us.
6.3 Participation in sports and other recreational activities are at the guests own risk. Sports facilities, equipment and vehicles should be checked thoroughly before use and deficiencies need to be claimed immediately.
6.4 There is no liability for loss of or damage to personal items brought and exhibited at the Ayurveda Centre. The disclaimer does not apply to cases in which a damage or harm is caused by intentional or grossly negligent breach of duty of Ayurveda Mallorca® or if it has occurred due to intentional or grossly negligent breach of duty by a legal representative or vicarious agent of the Centre.
7.1 The right of correction of errors and printing and calculation errors is reserved.
7.2 Verbal agreements are only effective if the Ayurveda Mallorca SL has confirmed these in writing.
7.3 Place of jurisdiction for all disputes arising from this contract and its performance, as far as legally permissible and otherwise agreed, is the court of Palma de Mallorca, Spain.
7.4 The invalidity of individual provisions of these general conditions or contract shall not affect the validity of the remaining provisions.
8. Private treatments
8.1 The guest / customer hereby acknowledges that all treatments and services provided by the Ayurveda experts of the health center are based on a private direct payment, regardless of a connection to a public health insurance.
8.2 Any costs incurred by medical examinations and treatments provided will be charged at the end of the stay. There is no entitlement to reimbursement by health insurance or benefits office.
8.3 There is no guarantee for the healing of a disease by the ayurvedic therapy.
